These Terms of Service govern your use of caribmania.ai and any services purchased from CaribMania Entertainment LLC, a Washington State limited liability company (“CaribMania,” “we,” or “us”). By accessing this site or placing an order, you agree to these terms.
1. Services
CaribMania provides AI-assisted video production, content creation, and Caribbean culture media services. Specific deliverables, timelines, and pricing are defined in the service agreement or invoice issued before work begins. No work commences without a signed service agreement.
2. Payments
Subscription tiers. CaribMania offers ongoing services on recurring plans:
• Starter — $897, billed once every three months ($299/month equivalent). Starter is available on quarterly billing only. There is no month-to-month option at this tier.
• Growth ($599/month) and above — available on month-to-month billing, or on quarterly billing where offered.
The plan, price, and billing interval you select at checkout govern your subscription until you change or cancel it.
Auto-renewal. Subscriptions renew automatically at the end of each billing period (every three months for Starter, monthly for month-to-month plans) using the payment method on file, at the then-current price for your plan, until you cancel. By subscribing, you authorize CaribMania to charge that method on each renewal date.
Cancellation. You may cancel at any time through your account or by emailing contact@caribmania.ai. Cancellation stops future renewals and takes effect at the end of the current paid billing period. You keep access to your plan through the period you have already paid for. We do not prorate or refund the unused portion of a billing period, including partial quarters on the Starter plan.
Changing plans. You may upgrade or downgrade between tiers. Upgrades take effect immediately and are billed on a prorated basis for the remainder of the current period. Downgrades, including a move from Starter to a month-to-month plan, take effect at the start of your next billing period.
Project and one-off work. For fixed-scope projects billed by invoice rather than subscription, payment is due per the terms on your invoice. Refunds are not issued for completed digital deliverables. If work has not yet begun, a refund may be requested within 48 hours of payment.
General. We accept the payment methods listed at checkout. All prices are in USD. Late payment or a failed renewal charge unresolved beyond 14 days may result in suspension of deliverables and account access until the balance is cleared. We may change plan pricing and will give at least 30 days' notice before a change affects your renewals; the new price applies from your next renewal after that notice period.
3. Client Responsibilities
You are responsible for providing accurate project details, brand assets, and feedback within agreed timelines. Delays caused by late client feedback do not extend CaribMania’s liability for missed deadlines.
You confirm that any content, materials, or references you provide do not infringe third-party intellectual property rights.
4. Intellectual Property
Upon full payment, you receive a license to use the final deliverable for the purposes outlined in your service agreement. CaribMania retains the right to display completed work in its portfolio unless you request otherwise in writing before project start.
Raw files, source prompts, and production assets remain the property of CaribMania unless explicitly included in the agreed scope.
5. Limitation of Liability
CaribMania’s liability is limited to the amount paid for the specific service in dispute. We are not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services or deliverables.
6. Governing Law
These terms are governed by the laws of the State of Washington. Any disputes shall be resolved in Washington State courts.
7. Changes to These Terms
We may update these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
